This Fair Use Policy (“Policy”) forms a legally binding agreement between you and Yuccan International Ltd (“we,” “our,” “us”). It applies to all users of Yuccan International Ltd’s online data services, APIs, databases, and hosted applications (“Services”). It is designed to ensure that all clients enjoy reliable, secure, and stable access, and that no single client’s activity disrupts or degrades the experience of others. It is also part of our
General Terms of Use. By using or accessing our websites, platforms, applications, and services (collectively, the “Services”), you agree to these Terms. If you do not agree, do not use the Services.
1. Principles of Fair Use
- (a) - The Services are intended for reasonable, responsible, and good faith use consistent with normal business or personal activity.
- (b) - All clients must use the Services in ways that do not compromise availability, security, or stability for others.
- (c) - Where usage is excessive, abnormal, or abusive, we may take protective measures under this Policy to safeguard the platform.
2. Examples of Unfair or Abusive Use
- (a) - Excessive polling or requests (e.g., automated queries every few milliseconds or other machine-driven intervals that materially exceed normal human usage).
- (b) - Unattended bots or scripts that log in or make repeated calls without authorisation.
- (c) - Attempts to bypass caching, throttling, or usage controls we implement.
- (d) - Automated scraping or harvesting of data beyond the lawful scope of your access rights.
- (e) - Any use of the Services that destabilises, overloads, or impairs the infrastructure, whether intentional or not.
3. Temporary Suspension for Protection
- (a) - Where we detect abnormal activity that places undue strain on the Services, we may temporarily suspend or limit that client’s access.
- (b) - Suspension will be used only as a protective measure to maintain platform stability and security for all users.
- (c) - We will provide notice to the client as soon as practicable, together with evidence of the activity that caused the suspension.
- (d) - Access will be restored promptly once the abnormal use is mitigated or remedied.
4. Permanent Restrictions
- (a) - If unfair use is persistent, repeated, or intentional, we may impose usage limits or throttling.
- (b) - We may require the client to migrate to a higher-capacity service plan.
- (c) - In severe cases, we may terminate the account in accordance with our Terms of Use.
5. No Limitation of Lawful Rights
Nothing in this Policy limits your lawful access rights to the Services. Normal use that falls within your subscription or access level will not be restricted, even if resource-intensive, provided it is consistent with the agreed scope of service.
6. Good Faith & Transparency
We commit to applying this Policy in good faith, consistently, and transparently. Our goal is not to limit fair usage, but to ensure system integrity, equitable access, and service continuity for all clients.
